Alabama Football respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Alabama Football service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.
This page describes the information that should be present in a DMCA notification.
Filing a DMCA Notice
If you are a copyright owner, or an agent authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Alabama Football Site, please submit a written notice to our Copyright Agent using the information provided below. - An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work itself.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Alabama Football to locate the material (e.g., the URL(s) of the specific content).
- Information reasonably sufficient to permit Alabama Football to contact you, such as your address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Counter-Notification
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to our Copyright Agent:
- Your physical or electronic signature.
- Identification of the content that has been removed or to which access has been disabled and the location (URL) at which the content appeared before it was removed or disabled.
- A statement that you have a good faith belief that the content was removed or disabled as a result of a mistake or a misidentification of the content.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in Tuscaloosa County, Alabama, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
Upon receipt of a valid counter-notification, we will promptly provide the complaining party with a copy of the counter-notification. The complaining party then has 10 business days to inform us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on the Site. If we receive no such notification within 10 business days, we may reinstate the removed material.
